Terms of Service

1. Agreement

These Terms are a contract between you and Codeaamy Private Limited ("Codeaamy", "we", "us"), Pune, Maharashtra, India. They cover the PostBuzz Mac app, the website at postbuzz.in, and the related services ("PostBuzz"). By creating an account or using PostBuzz, you agree to these Terms and to our Privacy Policy. If you use PostBuzz for a company, you confirm you may bind it, and "you" includes that company.

2. Who can use PostBuzz

You must be at least 16. If you are under 18, you need your parent or legal guardian's consent, and they accept these Terms for you and are responsible for your use. Paid plans must be bought by an adult. You must not use PostBuzz if the law or a sanction prevents you from doing so.

3. Your account

Keep your sign-in details secret. You're responsible for everything that happens in your account, including anything done by people you invite to a team. Tell us immediately at support@codeaamy.com if you think someone else has accessed it.

4. What PostBuzz does

PostBuzz studies the brand information you give it, uses AI to write and design drafts, lets you edit and approve them, and publishes approved posts at the times you choose. It does this from our servers, so your Mac can be off.

• Changes to PostBuzz: we improve PostBuzz continually, and we may add, change or remove features. The Mac app updates itself; you can also check for updates from the app menu.
• Beta features: some features are labelled beta or early access. They may change, break, or be withdrawn.
• No uptime guarantee: we work to keep PostBuzz available and on time, but we don't guarantee uninterrupted service or that every post will go out at the exact minute scheduled.

5. Your content

Ownership: you own what you put into PostBuzz and what it produces for you. That includes your brand material, uploads, drafts and published posts.

Your licence to us: you give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, adapt and transmit your content. This covers AI providers and posting services, and lasts only as long as needed to run PostBuzz for you and to meet legal obligations. It ends when you delete the content, except for copies already published on social networks or kept in routine backups for a limited time.

Your promise about your content: you have the rights to everything you upload and publish, including the logos, photos, product images, music, trademarks, and anyone's likeness it contains. Your content doesn't break any law or anyone's rights.

6. AI-generated content

• It can be wrong. AI output can be inaccurate, incomplete, similar to other people's content, or unsuitable. PostBuzz is told to use only the facts you give it, but you must check every draft before approving it, especially prices, offers, claims, dates, and statements about health, money, or results.
• You decide what's published. Nothing is published without your approval, and approving a post means you take responsibility for it.
• Label it where required. Where a network or the law requires AI-generated or synthetic media to be labelled, you must label it. That includes Meta's "AI info" rules and the EU AI Act's transparency rules.
• Don't use AI to deceive. Don't create realistic fake images or video of real people, or deceptive political or election content.
• Product Studio pictures: they are AI images built from your photo. Small details can shift, so check that they represent your product fairly.

7. Social networks and posting services

PostBuzz publishes through third-party posting services, mainly Upload-Post (upload-post.com), and for some older projects Ayrshare. These are intermediaries. Neither they nor PostBuzz are affiliated with, endorsed by, or sponsored by Meta (Instagram, Facebook), LinkedIn, X, or Pinterest. The networks' names and logos belong to their owners.

• When you connect an account, you authorize the posting service to publish to it for you. You must follow each network's terms, community guidelines, and API policies. Those terms apply to you alongside these Terms.
• Networks and posting services can change their rules, limit features, reject posts, require you to reconnect, or suspend accounts at any time. We don't control them and aren't responsible for their decisions, outages, or changes, or for any loss of reach, followers, or accounts that results.
• Publishing through third parties can occasionally fail, be delayed, or go wrong (for example, a post rejected or formatted differently by a network). PostBuzz reports each result, but you are responsible for checking that your posts appear as intended and for fixing or deleting them on the network.
• Posts already published stay on the network under its terms, even if you delete them in PostBuzz or close your account.

8. Acceptable use

You must not use PostBuzz to:

• publish anything illegal, defamatory, harassing, hateful, violent, sexually explicit, or harmful to minors
• infringe anyone's copyright, trademark, privacy, or publicity rights
• send spam, run fake engagement, or manipulate a platform (for example, fake accounts, buying followers, or coordinated inauthentic behaviour)
• impersonate someone, or mislead people about who you are or what you're selling. That includes false reviews, unsubstantiated claims, and undisclosed paid promotion.
• promote scams, weapons, drugs, gambling where it's illegal, or anything a network forbids
• break advertising, consumer-protection, anti-spam, or data-protection laws
• upload malware, probe or overload our systems, or get around credit limits, security measures, or plan limits
• copy, resell, reverse-engineer, or build a competing product from PostBuzz, except where the law expressly allows it
• share your account with people outside your plan

We may remove content, pause publishing, or suspend accounts that break these rules or put PostBuzz or our posting services at risk.

9. Plans, credits and payment

• Billing: paid plans are billed monthly in US dollars, in advance, and renew automatically until you cancel. Payments are processed by Stripe. Prices exclude taxes where taxes are added.
• Monthly allowance: each plan includes a monthly allowance of AI captions, banners, and posts to X. It resets at the start of each calendar month, and unused allowance doesn't carry over.
• Credit packs: one-off purchases, used after your monthly allowance runs out. They don't expire while your account is open.
• Failed AI tasks: if a generation fails, the credit is returned automatically.
• Your own AI keys: the provider bills you directly, and your use is subject to that provider's terms.
• Changing plans: upgrades are charged the prorated difference straight away. Downgrades take effect as a credit on your next invoice.
• Price changes: we'll tell you at least 14 days before a new price applies to your plan.
• Failed payments: if a payment fails, Stripe retries it. If it keeps failing, we may move you to the free allowance or pause paid features.

10. Our intellectual property

PostBuzz itself belongs to Codeaamy and its licensors: the app, website, software, designs, templates, and brand. You get a personal, non-transferable, revocable licence to use it under these Terms. If you send us feedback, we may use it freely.

11. Suspension and termination

You can stop using PostBuzz at any time. You can delete projects in the app, and ask us to delete your account. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if continuing would expose us, our posting services, or other users to harm. Where reasonable, we'll warn you first. When your account ends, publishing stops and we delete your data as our Privacy Policy describes.

12. Disclaimers

PostBuzz is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise any particular reach, engagement, followers, or business results, or that AI output will be accurate or original.

13. Limitation of liability

To the fullest extent the law allows:

• No indirect losses: Codeaamy is not liable for indirect, incidental, special, consequential, or punitive damages. That includes lost profits, revenue, data, goodwill, followers, or accounts.
• Third parties: we are not liable for the acts or omissions of social networks, posting services, or AI providers, or for content you approve and publish.
• Our total liability: for all claims about PostBuzz, it will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100.

Nothing here limits liability that can't be limited by law.

14. Indemnity

You'll compensate and defend Codeaamy against claims, losses, and costs (including reasonable legal fees) arising from:

• your content
• your posts
• your breach of these Terms or of a network's terms
• your violation of anyone's rights or of the law

15. Governing law and disputes

These Terms are governed by the laws of India. Before starting formal proceedings, please contact us so we can try to resolve the issue. The courts at Pune, Maharashtra have exclusive jurisdiction, although you may also have rights under the consumer laws of the country you live in.

16. Changes and general terms

We may update these Terms. We'll post changes here with a new date, and give notice of significant changes before they take effect. Continuing to use PostBuzz afterwards means you accept them.

• If any part of these Terms is unenforceable, the rest still applies.
• Not enforcing a term isn't a waiver.
• You may not transfer these Terms without our consent. We may transfer them as part of a reorganisation, merger, or sale.
• These Terms, the Privacy Policy, and the policies they link to are the whole agreement about PostBuzz.
